This agreement concerning the “Terms and Conditions for the use of the Cloud VPS service” establishes the conditions under which any person may visit or access the Acvile Cloud website or may use the service in any way. It constitutes an agreement between ACVILE TECH S.R.L (hereinafter referred to as “provider”) as the owner and administrator of the website and provider of the service, and any person who visits or accesses the website or wishes to use or actually uses the services in any way (hereinafter referred to as “user or client”).
The purpose of data collection is: providing Cloud-VPS services according to the current offer.

ACVILE TECH S.R.L responsibly treats the protection of your personal data and strictly applies the legislation in force. Below we present our policy regarding the processing of personal data, which allows you to be informed about the protection we guarantee and the purpose of collecting personal data.
As an authorized person (Web Hosting), from the perspective of the Regulation, we process only the personal data you have determined, for the time specified and for the purposes imposed by you as the operator. We ensure that your data is secure, remains your property, and is stored only on servers in Romania. The backup system is very well implemented and secured, located within the European space, and no one outside our technical department staff has access to these systems.
When registering to use our services, we may collect the following information about you:
Depending on the choices you make during authentication for our services or during the process of using our services, you may opt to provide the following additional personal data: your credit card details if you choose to provide this information, as well as your IBAN account.
It is prohibited to publish on the provider's servers content or links to such content that: (I) infringes or damages the intellectual property rights of others in any way or other rights; (II) contains obscene, pornographic, or violent material; (III) contains defamatory or slanderous content; (IV) has racial or discriminatory content; (V) contains viruses, trojans, or similar; (VI) contains pirated software or targets those who pirate software or engage in any similar activities. It is also prohibited to use our servers exclusively as storage support (e.g., movies, mp3s, pictures, etc.).
The client is responsible for updating contact information in the billing control panel when necessary. We cannot be held responsible for communication errors due to the client's failure to make the necessary updates.
The client is responsible for maintaining the security of usernames, passwords, and other sensitive information.
We cannot be held responsible for damage caused by the temporary unavailability of our servers, regardless of the reason causing this. This provision also includes damages resulting from data loss or corruption. The client agrees to indemnify and hold us harmless from any claims, damages, including, but not limited to, damages caused to third parties, resulting as a consequence of using services causing harm to our client.
The user declares that they understand and accept that, in any situation where the user requests damages of any kind from the provider, the total damages requested by the user for any reason and which could be paid by the provider will not exceed, in any case or form, the total amount of fees (charges) paid by the user to the provider.
The price for automatic backup is 20% of the server's value. The backup is performed automatically every 12 hours or can be manually created by the client from the administration interface. Restoration from the backup can also be done from the interface, requiring the service to be stopped until the restoration is completed.
Acvile Cloud has an annual average uptime of 99.5% for the internet network and servers installed in the data center.

Acvile Cloud reserves the right to send notifications regarding the services offered as well as announcements from third parties when these could benefit users.
The client agrees to pay in advance for our services by funding their account with Cloud Credit in their account balance. Credit can be used at any time, with services being billed hourly.
When the balance drops below 0 EUR, the client is repeatedly notified to fund their account. If the client does not fund the account within 15 days after the balance reaches 0, services will be suspended. After another 30 days of suspension, services will be permanently deleted from Cloudify servers and cannot be restored.
Every purchased service includes technical support.
Acvile Cloud provides clients with an email address and a live-chat interface to communicate with technical operators for support.
Products are exclusively electronic services (VPS). Delivery is instant, occurs online, and is done through the user interface of the Acvile Cloud website.
Clients may request a refund of deposited amounts within 30 days. If applicable, active services at the time of the return request will be deactivated.
We reserve the right to make additions, cancellations, or changes to Terms and Conditions, prices, or the website at any time, with notifications being made through the website or the customer control panels.
